The 2012 Minnesota State Legislature has enacted several changes to Minnesota Statutes that relate to the responsibilities of all licensed Minnesota School Administrators, including licensed Superintendents, Principals, Directors of Special Education, and Directors of Community Education.

There are two changes relating to the $75.00 Annual Fee school administrators must pay that are collected by BOSA:
  1. There will be a statutory imposed penalty for school administrators for non-payment of the $75.00 Annual Fee.
  2. As part of the transition to a Fiscal Year Fee, BOSA will collect a fee of $37.50 covering the period January 1, 2012 to June 30, 2012, due July 31.  The $75.00 fee for the period for Fiscal Year 2013 (July 1, 2012 through June 30, 2013) will be due November 15, 2012.
Background

Over the course of the past eleven years, between forty and sixty-nine percent of all licensed administrators complied with the original 2001 statute and paid the $75.00 Annual Fee without the existence of statutory imposed penalty. BOSA, noting the lack of voluntary compliance with the original statute, developed enforcement language, and a change from annual to fiscal year billing cycles. The changes were signed into law on April 30, 2012 by Governor Dayton.

The change in Minnesota Statutes 122A.14 Subdivision 9 now reads:

"...any licensed administrator who does not pay the fee in the given fiscal year shall have all administrative licenses held by the person automatically suspended, without the right to a hearing, until the fee has been paid to the board.  If the board suspends a licensed school administrator for failing to pay the fee, it must immediately notify the school district currently employing the a school administrator of the school administrator's suspension..."

Transition Issues from Annual Fee to Fiscal Year Fee in 2012

No Annual Fees for calendar year 2012 have yet been billed. 
The schedule to collect the Fees for January 1, 2012 through June 30, 2012 is as follows:

Specifics on the changes will be communicated to all Minnesota licensed administrators by way of U.S. mail sent to the home address of each administrator on file with the MN Department of Education educator licensing.

In order for Minnesota school administrators to have their own monitoring board, the legislature required that MN BOSA be self-supporting. Therefore, all school administrators must pay an annual fee of $75. This amount is in addition to any licensing/re-licensure fee and is payable to the Minnesota Board of School Administrators. MN BOSA sends all school administrators a letter informing them of this obligation.

If MN BOSA were not self-supporting, all its responsibilities would most likely revert back to the Commissioner of Education. A school administrator does not join the MN BOSA; rather, MN BOSA fulfills the above stated duties for all Minnesota school administrators.
